EPR Motorsports – Everest Performance & Racing
These Terms of Service apply to your use of the EPR Motorsports website and to purchases made through our online store. By accessing our website or placing an order, you agree to these Terms.
1. General
EPR Motorsports supplies automotive performance parts, engine components and related products.
We reserve the right to update these Terms from time to time. The version published on our website at the relevant time will apply to your use of the website and, subject to applicable law, your purchase.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot legally be excluded under the Australian Consumer Law or other applicable legislation.
2. Online Store
You must provide accurate and complete information when placing an order.
You are responsible for ensuring that your contact, billing, shipping and vehicle/application information is correct.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:

Pricing or product information contains an obvious error;

We reasonably suspect fraudulent or unauthorised activity; or

We are unable to supply the product.
If we cancel an order after payment has been received and no goods have been supplied, the applicable amount will be refunded.
3. Pricing & Payment
Unless otherwise stated, prices displayed on our website are in Australian Dollars (AUD).
Applicable taxes and shipping charges will be displayed or calculated during checkout where relevant.
Prices, product availability and promotions may change without notice. Changes will not affect an order that has already been accepted except where permitted by law.
4. Product Information
We make reasonable efforts to ensure product descriptions, specifications, photographs, pricing and compatibility information are accurate.
Automotive performance products can have application-specific requirements. Vehicle modifications, engine conversions, aftermarket components and previous modifications may affect compatibility.
Customers should confirm suitability before installation.
If you are unsure whether a product suits your vehicle, engine or application, contact EPR Motorsports before purchasing or installing the product.
5. Vehicle Fitment & Compatibility
Vehicle and engine references such as Ford Barra, Falcon, BA, BF, FG, FGX and XR6 Turbo are provided to help identify potential applications.
A reference to a vehicle or engine does not necessarily mean a product will fit every model, variant, modification or configuration within that range.
The customer and/or installer is responsible for confirming final compatibility before installation.
This section does not limit any rights relating to goods that are incorrectly described or otherwise fail to comply with Australian Consumer Law.
6. Performance & Motorsport Products
Some products sold by EPR Motorsports are designed for modified, high-performance, competition or motorsport applications.
Performance results can vary significantly depending on the engine combination, vehicle, fuel, tuning, supporting modifications, installation and operating conditions.
Unless expressly stated otherwise, advertised performance figures or manufacturer ratings should not be interpreted as a guarantee that a particular vehicle will achieve a specific power output or performance result.
Customers are responsible for determining whether modifications comply with applicable road, emissions, registration and motorsport requirements.
7. Installation
Automotive performance components should be installed by a suitably qualified or experienced person where appropriate.
Incorrect installation, incorrect tuning, insufficient supporting modifications, misuse or operation outside the manufacturer's intended specifications may cause component or engine failure.
EPR Motorsports is not responsible for loss or damage caused by improper installation, misuse or unauthorised modification to the extent permitted by law.
Nothing in this section excludes liability that cannot legally be excluded.
8. Orders & Availability
Submitting an order does not necessarily guarantee availability.
If an ordered product becomes unavailable, we may contact you regarding an alternative, backorder or refund as appropriate.
Special-order products may have different lead times and return conditions, which will be communicated where applicable.
9. Shipping & Delivery
Delivery estimates are estimates only unless expressly guaranteed.
Delays may occur due to freight carriers, suppliers, weather, peak periods or circumstances outside our reasonable control.
Customers are responsible for providing an accurate delivery address.
Our obligations concerning delivery remain subject to Australian Consumer Law and other applicable legislation.
10. Returns, Refunds & Warranties
Returns and refunds are also governed by our Returns & Refund Policy.
Manufacturer warranties may apply to certain products.
Warranty claims may require inspection, testing, proof of purchase and information regarding installation and use.
Any manufacturer warranty is in addition to, and does not replace, rights that may apply under Australian Consumer Law.
11. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You may be entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage. You may also be entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms is intended to exclude, restrict or modify a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
12. Intellectual Property
Unless otherwise stated, content created or owned by EPR Motorsports on this website, including branding, logos, original photographs, graphics, written content and website material, remains the property of EPR Motorsports or its respective rights holder.
You may not reproduce, distribute or commercially exploit our protected content without permission, except where permitted by law.
Third-party trademarks and brand names remain the property of their respective owners.
13. Prohibited Use
You must not use our website:

These Terms are governed by the laws applicable in New South Wales, Australia, and applicable Commonwealth laws.
Nothing in this section limits any rights a consumer may have regarding jurisdiction under applicable consumer legislation.
